Who is the person designated to provide first aid in the workplace?

This is an employee appointed by their employer to carry out first aid activities. Interestingly, the employer does not have to obtain consent or a statement for such a „nomination” from such a person, because it is an organizational decision of the employer. There is also no need to change the content of the employment contract or the scope of duties of such an employee. The person designated to provide first aid must have up-to-date health and safety training, while the employer may refer such an employee to an additional first aid course to increase their competence in this area. Certainly, an employer should not entrust such functions to people who, for example, are afraid of the sight of blood, panic in emergency situations, are unable to act under time pressure and stress.

In addition to rescuing employees from predicament in case of cuts, sprains and burns, the person designated to provide first aid also takes care of and supervises first aid kits or first aid points designated by the employer. Designated employees control the content and expiry dates of the products in the first aid kit. Its actions should be quick and effective in the event of a medical emergency, it should be able to control the situation at the scene of the incident by coordinating individual actions and, if necessary, calling the appropriate emergency services.

The law does not provide for liability for an employee who makes a mistake while administering first aid in an emergency. Civil liability could be applied in a situation where such an employee does not carry out inspections of first-aid equipment as determined in accordance with the company’s internal procedure, if he or she is obliged to do so. On the other hand, every employee, regardless of their position and functions, is subject to criminal liability for failing to provide assistance to a person in a situation of direct threat to life or health. However, we should remember that first aid is not only heart massage, artificial respiration and bandaging, but also making a phone call to the emergency number and notifying the appropriate services about the incident.
