When should an occupational health and safety service be established in the workplace?

The form of organization and composition of the occupational health and safety service depends on the number of employees in the workplace and the risks and nuisances related to the work performed in the workplace. If the workplace employs:

  • up to 100 employees, tasks related to occupational health and safety may be entrusted to an employee employed in another job (performing other professional duties in this establishment), in the absence of competent employees – the performance of occupational health and safety service tasks may be entrusted to specialists from outside the workplace,
  • from 100 to 600 employees, at least a one-person occupational health and safety position should be created or a part-time occupational health and safety employee should be employed in such a position,
  • more than 600 employees, at least one occupational health and safety officer must be employed full-time for every 600 employees.

Pursuant to Art. 23711 § 4 of the Labor Code, the labor inspector may order the establishment of an occupational health and safety service or an increase in the number of employees of this service, if it is justified by identified occupational hazards.

Each employee of the occupational health and safety service and an employee employed in another job entrusted with performing the tasks of the occupational health and safety service, as well as a specialist from outside the workplace, should meet the qualification requirements necessary to perform the tasks of the occupational health and safety service and complete occupational health and safety training for employees of this service. They cannot also suffer any unfavorable consequences due to the performance of the tasks of this occupational health and safety service.

It should be emphasized that it is good employer practice to employ an occupational health and safety inspector despite the lack of such an obligation. This is completely acceptable. Such action allows for systematic and thorough verification of the safety status at the plant, as well as carrying out supervision and implementing preventive actions.
