Who can clean the air conditioning in the workplace?

Generally applicable health and safety legislation does not contain detailed solutions for cleaning air conditioning. It must therefore be considered that this work is permitted under normal conditions.

Workers should first of all have the required skills and knowledge of the health and safety regulations referred to in Article 2373(1) of the Labour Code. These requirements should be confirmed by health and safety training (general instruction, job instruction, periodic training) and before the worker is admitted to this work, he should also obtain a medical certificate stating that there are no medical contraindications to the performance of work in accordance with the conditions described in the referral for preventive medical examinations. The referral, on the other hand, should be consistent in its content with the results of the occupational risk assessment, which should take particular account (if any in this particular case):

  • work at height,
  • dangerous biological agents,
  • hazardous chemical agents,
  • manual handling of loads,
  • risks associated with the use of power tools, etc.

The work itself should be carried out on the basis of health and safety instructions, for which the requirements are laid down in § 41 of the Regulation on general health and safety regulations. Those instructions shall be clearly understood by workers to indicate the steps to be taken before the start of the work in question, the principles and means of carrying out the work safely, the activities to be carried out after the work has been completed and the rules for dealing with emergency situations which pose a risk to the life or health of workers. Instructions for work on the use of hazardous substances and chemical preparations should take into account the information contained in the safety data sheets of those substances and preparations.

The employer’s instructions should also take into account the maintenance and cleaning requirements of the air conditioning system as specified by the manufacturer. If, according to the manufacturer’s guidelines, cleaning air conditioning requires special knowledge and skills, then the employer should ensure that these requirements are met. According to Paragraph 32(2) of the Regulation on minimum health and safety requirements for the use of machinery by workers at work, the employer is required to take the necessary measures in order for workers carrying out repairs, modernisation, maintenance or maintenance of machinery to receive specific training in that regard.

It is also important to bear in mind the need to comply with obligations relating to particularly hazardous work (e.g. work at height, work with hazardous chemicals), in accordance with Chapter IV of Chapter 6 of The Regulation on general provisions on health and safety at work.
