Is the employee entitled to a refund for the purchase of glasses for work at the computer?

Yes, the legislation obliges the employer to provide employees with eyeglasses, as recommended by the doctor, if the results of ophthalmic examinations carried out as part of preventive health care show the need for their use when working with a screen monitor.

The scope and principles of preventive health care, which the employer is obliged to provide to employees in positions equipped with on-screen monitors, are laid down in the Labour Code and in the Regulation of the Minister of Labour and Social Policy of 1 December 1998 on health and safety at work in stations equipped with screen monitors (Journal of Laws No. 148, item 973).

Paragraph 8 of the Regulation expressly requires the employer to provide the employee with eyeglasses if the results of ophthalmic tests carried out as part of preventive health care show the need to use them while working at the computer.

The provisions of the Regulation do not specify the amount of reimbursement of the costs of the employee’s purchase of eyeglasses used when working at a computer. It is up to the employer to make the indicated refund, whether he will reimburse the employee for the full cost of purchasing glasses or just frames or glasses, and what period of time he will make the refund.

The employer should clearly and concretely set the rules applicable to his company regarding the manner and amount of the refund. It can do this by placing the relevant provisions in the employment regulations or otherwise accepted in the company.

The first step is to refer the employee to preventive examinations and obtain a certificate from an eye doctor about the need for eyeglasses when operating the computer. The employee then purchases the glasses and presents the bill to the employer for reimbursement.

The Regulation does not regulate the basis on which the bill or invoice is to be refunded. The invoice may be issued to the employee who presents it to the employer, accompanied by a doctor’s certificate stating the need for glasses.

The National Labour Inspectorate also commented on the reimbursement by the employer of the cost of eyeglasses for work at the computer. It stated that the employer may have doubts as to the obligation to bear the full cost of wearing the glasses. However, there is a fair case for the employer to bear the full cost of labour and glasses with parameters indicated by the doctor. On the other hand, there is no formal obstacle for the employer to limit his share of the cost of the binding by fixing an amount of participation which is not less than the cost of the luminaire corresponding at least to the basic standard.
