What are the characteristics of a good mediator?

Mediation is a structured process that involves a third party to resolve a conflict between negotiating partners. The mediator must be absolutely impartial and not emotionally involved in the case. It must also obtain the acceptance of both conflicting parties. He should look at the conflict from a certain perspective and look for areas of agreement. Finally, together with the negotiating partners, he should develop recommendations that will be acceptable to both parties.

A good mediator should:

  • be trustworthy;
  • remain neutral towards the parties to the conflict and towards the object of the conflict;
  • understand each party’s position;
  • be guided by the interests of the parties involved in the conflict;
  • involve the parties in mutual arrangements;
  • keep in mind the goal of developing the most satisfactory solution for the parties;
  • ensure, if possible, psychological comfort for the conflicting parties;
  • keep information entrusted to him confidential.

However, a good mediator should not:

  • attempt to change the mind of either party;
  • decide for yourself;
  • present your own solutions to the websites.

From a technical point of view, mediation should take place in several stages:

  • Contact with the parties that initiates the work
  • Assessment of the situation and preparation of the parties for the trial
  • Opening session for the parties
  • Session appropriate for the parties
  • Mediation protocol
  • Divorce agreement or no agreement at all
