Who is obliged to perform psychotechnical tests?

Psychotechnical examinations must be performed by employees or job candidates who need special mental characteristics to perform their professional duties – including employees who drive a car as part of their official duties.

Psychotechnical examinations must be performed by:

  • employees employed as drivers – suppliers, couriers, drivers of emergency vehicles, as well as self-employed persons operating in the field of road transport. They carry out psychotechnical tests in accordance with the Road Transport Act. The examination ends with a psychological certificate valid for a maximum of 5 years. They are given to the employer who issued the referral, and in the case of self-employed people, they should be carried with them.
  • Employees employed in other positions who use both a company car and a private car for business purposes in their work. They undergo examinations in accordance with the Act on Occupational Medicine.
  • driving instructors and examiners,
  • machine and device operators,
  • people working at heights,
  • miners,
  • drivers employed in companies such as Uber or Bolt,
  • tram driver,
  • crane, excavator, forklift, overhead crane, heavy road machinery operators,
  • candidates for city guards,
  • security agency employees,
  • judges,
  • detectives,
  • persons selling and manufacturing explosives candidates,
  • drivers referred by the Police, the Mayor of the City or the Starost (persons who drove a car under the influence of alcohol or other intoxicants, or who exceeded 24 penalty points, or participated in an accident in which a person was injured or died).

Pursuant to the Regulation of the Minister of Health on psychological examinations of persons applying for driving licenses, drivers and persons working as drivers (Journal of Laws of 16 July 2014, item 937), the scope of psychological examination in the field of transport psychology includes :

  • Direct interview and observation of the examined person
  • Examination with diagnostic tools
  • Evaluation and description of the examined person in terms of: intellectual ability and cognitive processes,

personality, including functioning in difficult situations, also social maturity,

psychomotor skills.

According to par. 2 of the aforementioned regulation, persons with a referral for a psychological examination in the field of psychology of transport must report within no more than 30 days of receiving the referral. The condition for conducting the examination is to have a valid identity document with you.

An authorized psychologist may refuse to conduct an examination if the examined person informs about his/her malaise or poor health or if there is a suspicion that he/she may be under the influence of alcohol or other intoxicants. In this case, the psychologist sets a new date for the examination, which may not exceed 14 days.

The cost of a psychological examination in the field of transport psychology is PLN 150. Employees perform them at the employer’s expense (Article 229(6) of the Labor Code).

Possession of category B driving license is a frequent condition for obtaining employment, as in many professions driving a car as part of the employee’s duties is necessary. Sales representatives, procurement specialists and regional coordinators use a passenger car every day, but there are also professions where driving a company car is used occasionally at work. An accountant who goes to the tax office or a secretary who goes to the post office by car, even a private one, must have an examination for the driver.

Each daily or occasional use of the car as part of their professional duties requires the employee to undergo additional examinations by an ophthalmologist. The purpose of this test is, apart from the typical assessment of the efficiency of the eye, also the assessment of twilight vision and reaction to glare.

Although the Regulation of the Minister of Health on medical examinations of drivers and persons applying for driving licenses (Journal of Laws No. 2, item 15, as amended) does not directly regulate these issues, according to the National Consultant for Occupational Medicine, the standard the scope of medical examinations of persons who are not employed as a driver and drive motor vehicles as part of their professional duties should include:
