Which institutions operate in the field of OHS protection?

  • The National Labour Inspectorate (PIP) is the most important national institution supervising labour law regulations in workplaces, in particular in terms of compliance with OHS.

The Chief Labour Inspector (GIP) is appointed to manage the PIP, while individual workplaces are subject to inspectors from 16 district labour inspectorates.

The competences of PIP and labour inspectors include control of compliance with labour law and health and safety rules, issuing orders to employers or suspending work at endangered positions, control of compliance with the employer’s obligations related to remuneration for work and timeliness of its payment, time of work performance, use of holidays by employees, as well as control of compliance with occupational health and safety regulations during design,  construction, reconstruction and modernization of workplaces and their equipment machines, technical devices or technologies.

Inspectors are entitled, among others, to enter the premises of the inspected entity and its facilities, inspect objects, rooms, workstations, machines and devices, as well as the course of technological processes and work. A representative of PIP may request any documents related to the inspection, record the course of inspection using a camera or other technical means, check the identity of persons staying on the premises of the workplace or use the help of appropriate experts and specialists.

In the event of misconduct, the authority may impose fines on the employer, submit notifications to the prosecutor’s office about the possibility of committing a crime by the employer, submit applications for punishment to district courts, as well as issue an administrative decision on fines, which may amount to up to several dozen thousand zlotys.

  • The National Sanitary Inspectorate (PIS, „Sanepid”) controls the conditions of occupational hygiene along with tests and measurement of concentrations and intensities of harmful factors. The superior person here is the Chief Sanitary Inspector subordinate to the Minister of Health. Direct supervision over workplaces belongs to district sanitary and epidemiological stations. The main tasks of the Sanepid include checking the conditions: environmental hygiene and work in workplaces; radiation hygiene; hygiene of teaching and upbringing processes; hygiene of rest and recreation.

Sanepid also controls the health conditions of food, nutrition, objects of use and hygienic and sanitary for medical staff and rooms intended for health services. In the event of irregularities, PIS may impose penalties and demand their removal.

  • The State Fire Service supervises workplaces in terms of compliance with fire regulations and deals with the identification of related hazards. To do this:
  • carry out inspections of buildings;
  • check the condition of the fire-fighting installation and equipment;
  • checks the state of preparation of the workplace for the need for evacuation.
  • Office of Technical Inspection and Construction Supervision

The task of the Office of Technical Inspection is to guarantee the proper and safe operation of machines, supervision and control of compliance with the provisions on technical supervision, as well as the performance of technical supervision itself.

The Office’s control, for example, may concern technical devices that pose a risk of expansion of gases under pressure, release of potential or kinetic energy during the movement of people or cargo, spread of hazardous materials during their storage or transport.

Construction Supervision checks whether the provisions of the construction law are observed, especially in the context of the safety of people and property. Representatives of the Construction Supervision authority can inspect both the construction object and the construction site or workplace. In the field assigned to it, similar functions are performed by the Road Inspection and the Higher Mining Office.
