What is the working time of a disabled person?

An entity employing people with disabilities should meet a number of formalities and ensure proper working conditions, but it can also count on the benefits that employing such an employee brings. In this context, working time is important, which was directly defined in the Act on Vocational and Social Rehabilitation and Employment of Disabled Persons of 27 August 1997.

The standard working time of a person with a disability certificate is no more than 8 hours a day and no more than a total of 40 hours per week. Information on this subject can be found in Article 15 of the aforementioned Act. At the same time, these persons may not perform their duties during overtime and at night. This requirement should be applied regardless of the degree of disability and regardless of the consent of both parties to the employment relationship.

A slightly different working time applies to people with a severe or moderate degree of disability. Then this time may not exceed 7 hours a day and a total of 35 hours throughout the week. This is enshrined in Article 15(2) of the Act on Vocational and Social Rehabilitation and Employment of Disabled Persons.

Polish law includes two basic exceptions, in which there is no ban on night work and overtime and short-time work for a disabled person. This is directly regulated by the provisions of Article 16 of the aforementioned Act. Exceptions relate to:

  • persons employed in guarding (i.e. monitoring or guarding property);
  • disabled persons in whom the attending physician agrees to extended working time or performance of official duties in overtime and at night.
