What changes the replacement of the state of epidemic with the state of epidemic threat?

In accordance with the Regulation of the Minister of Health on the cancellation of the state of epidemic in the territory of the Republic of Poland, on May 16, 2022, the state of epidemic in Poland was abolished. At the same time, under the new regulation, a state of epidemic emergency was introduced from the same day.

The introduction of the state of epidemic emergency in Poland will not radically change the situation. In accordance with the Act of 5 December 2008 on the prevention and control of infections and infectious diseases in humans. Most COVID-19 related activities are in place in both epidemic and emergency states.

The state of epidemic threat, like the state of epidemic, makes it possible to return at any time to the previously applicable restrictions in the event of an increase in the number of infections. There is also a legislative possibility to return to the state of epidemic at any time by means of a new regulation.

The introduced legislative change does not entail direct changes in the provisions concerning employees. This applies m.in to the possibility of remote work by the employee. The employer will still be able to direct employees to perform work outside the place of its permanent performance.

According to the regulation introducing the state of epidemiological emergency in Poland, the following are subject to mandatory vaccinations:

1. persons practising a medical profession in entities performing medical activity and persons performing professional activities in these entities, other than the exercise of a medical profession;

2. employed persons and persons providing pharmaceutical services, professional tasks or professional activities in a public pharmacy or pharmacy outlet;

3. students studying in the fields of study preparing for the medical profession
