Is on-the-job instruction mandatory?

Every employee employed on the basis of an employment contract should undergo initial OHS training. However, not everyone remembers that full initial training consists of general instruction and on-the-job instruction.

The obligation to undergo general instruction before being allowed to work in a specific position applies to a newly hired employee, a student undergoing student practice, as well as students of vocational schools undergoing practical vocational training. This instruction is carried out by: an employee of the OHS service, a person performing the tasks of this service, an employee appointed by the employer – having the knowledge and skills to ensure the proper implementation of the instruction program or an external company. These rules are set out in the Regulation of the Minister of Economy and Labour of 27 July 2004 on training in the field of occupational health and safety. General instruction should last at least 2 hours and 15 minutes, because its program is written for a minimum of 3 teaching hours.

Referring to the wording of the said regulation of the Minister of Economy, on-the-job instruction is carried out before being allowed to perform work in a specific position:

  • a worker employed in a worker’s and other post who is exposed to factors harmful to health, burdensome or dangerous;
  • a worker transferred to the post referred to in point 1;
  • a student undergoing practical vocational training and a student undergoing student internship.

On-the-job instruction is carried out in order to:

  • familiarize the employee with the factors of the working environment occurring at their workplaces
  • familiarization with the occupational risks associated with the work performed;
  • familiarize with the methods of protection against the threats that these factors may cause and methods of safe work at a given position.

The time depends on the type of position. For administrative and office positions it is a minimum of 2 lesson hours, for the remaining minimum 8. It is worth emphasizing the word „minimum” here. This means that the employer can extend the duration of the instruction if he sees the need. The duration should depend on the education, professional preparation of the employee, and his professional experience is also taken into account. This issue also depends on the employee’s previous seniority.
