What was the subject of the Meeting of the Social Dialogue Development Team in November 2021?

Discussion of the issue of access to information necessary to conduct a strike referendum, current activities and problems of the Voivodship Social Dialogue Councils of the Lubuskie, Wielkopolskie, Mazowieckie and Podlaskie voivodships and the issue of expertise on collective agreements in Poland were the main topics of the meeting of the team for the development of social dialogue. The meeting took place on November 10, 2021 in a hybrid form. The government was represented in the meeting by Barbara Socha – Undersecretary of State in the Ministry of Family and Social Policy

B. Surdykowska – NSZZ „Solidarność” presented the problem of access to information necessary to conduct a strike referendum. She referred to the issue of obtaining personal data of employees by the trade union for the purpose of conducting a strike referendum or informing employees about individual actions taken by trade unions. She presented proposals to amend the provisions of the Act on Trade Unions. Explanations in this respect were provided by Monika Krasińska – Director of the Department of Jurisprudence and Legislation of the Personal Data Protection Office.

It was agreed that the social side would autonomously work out proposals for amendments to the Trade Unions Act.

The next point discussed was the information of representatives of the WRDS of the lubuskie, Wielkopolskie, Mazowieckie and Podlaskie voivodships regarding current operations. Among the topics discussed was the issue of the decreasing role of social dialogue, problems faced by councils at the regional level and positions/resolutions taken by WRDS and their further implementation.

Chairman W. Ilnicki summed up that material from meetings with representatives of WRDS will be prepared illustrating m.in problems faced by councils.

In the further part of the meeting, the issue of expertise on the practice of collective agreements in Poland was raised. President W. Ilnicki informed that the application, after modification of the thematic scope of the expert opinion, will be sent to the Presidium of the RDS.

Then, Deputy Director Agata Oklińska informed about the state of work on the Act on the Resolution of Collective Disputes. She stressed that the application for entry in the list of legislative works of the RM of the draft law on collective labour disputes was forwarded for consideration to the management of the Ministry of Family and Social Policy.

In various matters, m.in the issue of convening tripartite Industry Teams for Road Transport, Automotive, Food and Shipbuilding was raised.
