What is bullying and how can it be recognized?

Mobbing is the deliberate, persistent psychological harassment of an employee verbally or non-verbally by a supervisor or colleague, or even more people or the entireorganization (its managers). As a consequence of such behavior, the employee is in a bad mental state, manifested by reduced self-esteem, a sense of seclusion and even anxiety.

It is essential that in ordertorecognise a particular person as a victim of harassment, all factors must exist at the same time, namely:

  • activities or behaviour relates to or directed against the worker,
  • actions or behaviours are prolonged and persistent,
  • activities or behaviour consist of harassment or intimidation,
  • the purpose of the impact is to humiliation or ridicule the employee, isolate him from colleagues or eliminate him from the team;
  • as a result of the employee’s actions, there is an underestimation of professional fitness, as well as a feeling of humiliation or ridicule, or isolation or elimination from the team of colleagues

Harassment can take many forms. Any adverse reactions can affect different aspects of working life in different ways. The classification of these activities includes:

  • activities that negatively affect the communication process,
  • activities that negatively affect inter-employee relations,
  • activities that negatively affect the perception of the employee in the working environment,
  • activities adversely affecting the employee’s professional position,
  • adverse effects on the health of the worker.

If an employee feels that they are the victim of harassment in the workplace, they should counteract it as soon as possible. The first step is to notify your supervisor of the fact. If the mobber (the mobber) is the superior of the victim, please contact senior management or the human resources department for assistance if we know that we will receive the expected support. From a legal point of view, the victim of harassment can expect measurable compensation for the harm suffered. The victim may seek compensation for mental or physical damage – the court, based on the opinion of the expert doctor, determines the amount of compensation. The second possible benefit is compensation for losses incurred as a result of dismissal by harassment. However, before the victim can seek compensation for the wrongs suffered, he must prove to the court that the harassment actually took place.

Whether the harassment actually occurred is decided by the court. Unfortunately, matters relating to harassment at work are not easy. First, usually considered for a long time. They require the establishment of many circumstances, the examination of various evidence and the questioning of many witnesses – most often the victim’s associates. Secondly, it should be borne in mind that, unfortunately, it is up to the victim to prove that the accused person has actually committed harassment. This is very difficult for the victim, because as a result of being subjected to harassment, he is usually an intimidated person who does not believe in his own strength. In addition, daily functioning in a professional environment, which is sometimes also negatively geared towards the victim, can be particularly difficult and mentally aggravating.
