What is arbitration?

Arbitration is one of the methods of resolving a dispute, the so-called arbitration court, because its main feature is that the dispute is settled without the participation of a common court.

Arbitration is most often used in commercial and civil cases, i.e. also exactly as described in the question. The arbitration court’s judgment may be the basis for initiating bailiff enforcement, which for an entrepreneur who actually performed the service and did not receive contractual payment means recovery of receivables.

Both parties must agree to arbitration. To submit to it, they have the opportunity to:

  • making an arbitration clause already in the contract,
  • conclude an additional agreement to submit to arbitration at the time of the dispute.

A clause in contracts normally given in final provisions may read, for example: „Any dispute arising out of or in connection with this agreement shall be resolved by the Court of Arbitration in accordance with the rules of this Court.”

In Poland, there are about 50 operating arbitration courts, including online courts, i.e. those that carry out the process fully online.
