Thanks to the use of collective agreements, workers can benefit from working conditions tailored to their needs. Conventions Collectives in France determine the shape of employment in 98% of cases.

The Labour Code is general and only defines the framework within which working conditions can be specified. Unlike in Germany, this is not due to the strong position of the trade unions, but to the efforts of the Ministry of Labour, which has implemented appropriate procedures.

Thanks to the use of collective agreements, workers can benefit from working conditions tailored to their needs. Laws covering relatively narrow groups of specialists allow better consideration of the specificity of individual industries. It is also easier to renegotiate the terms of employment, which affects the flexibility of this solution that is beneficial for both parties – in the case of the Polish Labor Code, it is much more difficult to find equally flexible rules of functioning.

Collective agreements negotiated between employers and trade unions define all working conditions and social security of employees. It happens that collective agreements are concluded, referring only to a specific aspect (working time, wages, holidays, etc.). Agreements as well as collective agreements can be concluded at many levels – industry, enterprise or plant. The employee is bound by those provisions that are most favorable to him – the agreement at the level of the company may not impose working conditions worse than those resulting from the provisions in the sectoral collective agreement; however, it can introduce wages higher than those required in the industry. The Ministers of Labour, Social Relations and Solidarity, agriculture and fisheries have the opportunity to „extend” the scope of what they consider to be a good collective agreement, e.g. at company level, to all actors in the sector of activity concerned.

Before taking up employment , you should:

  • Find out what collective agreement is in force in your workplace,
  • read its content (you can ask for the Polish language version of the document).

During employment, it is worth checking whether the rates and benefits you receive from the employer are in accordance with the applicable collective agreement.
