Whatkind of work can juvenile workers do?

According to the Labor Code, a juvenile employee is considered to be a person over 15 years of age who is under 18 years of age. However, not all jobs can be performed by juveniles and certain conditions must be met before employment.

A juvenile worker may be employed only if the person concerned has completed at least eight years of primary school and has medical certificates stating that the work performed does not pose a health risk. The law generally prohibits the employment of people under the age of 15. There are a few exceptions to this rule, but only if the work carried out is an apprenticeship.

As a rule, a juvenile worker can only be employed for light work. If a juvenile worker does not have the appropriate professional qualifications, he can only be employed on the basis of an apprenticeship. Light work is considered to be those that do not pose a threat to life and health as well as mental development, moreover, do not hinder the juvenile from fulfilling the obligation to attend school. In the provisions of labor law, they do not provide any list of light works. The basis is the doctor’s opinion and the employer’s decision.

An employer employing juvenile workers is obliged to include in the work regulations a list of works prohibited and permitted to such employees. This list must be approved by the relevant labour inspector. Before starting work, a juvenile worker should be acquainted with it and the list itself must be posted in the workplace. It is strictly forbidden to carry out the work contained in the Council of Ministers of 24 August 2004 on the list of works prohibited from juveniles and the conditions of their employment in some of these works.

As already mentioned, before starting work, a juvenile must absolutely obtain a ruling on the absence of health contraindications, he should also undergo periodic examinations within the deadlines set by the doctor. If the doctor finds that there is health harm, the juvenile should be immediately removed from performing the work in question.

In terms of cat work:

  • A juvenile may not work more than 8 hours a day (a juvenile up to 16 years of age – 6 hours).
  • The working time of a young person includes the time of education in the amount resulting from the compulsory school curriculum, regardless of whether it takes place during working hours.
  • If the daily working time of the juvenile is longer than 4.5 hours a day, you must introduce a break in work of 30 minutes continuously, included in the working time.
  • A juvenile may not be employed overtime or at night (the night time for a juvenile is between 22:00 and 6:00, and in special cases – especially a juvenile who is under 15 years of age – the night time is between 20:00 and 6:00).
  • A break in the work of a juvenile covering the night time should last not less than 14 hours continuously.
  • A juvenile shall be entitled to at least 48 hours of uninterrupted rest each week, which shall include Sunday.
