What is the obligation to consult in the field of OSH?

The employer is obliged to consult with workers or their representatives on all activities related to occupational safety and health, regardless of how many employees he employs.

The obligation to consult concerns in particular:

  • changes in the organization of work and the equipment of workplaces, the introduction of new technological processes and chemical substances and mixtures thereof, if they may pose a threat to the health or life of workers;
  • assess the occupational risks involved in the performance of specific work and inform workers about those risks;
  • creating an OHS service or entrusting the performance of the tasks of this service to other persons and appointing employees to provide first aid, as well as performing activities in the field of fire fighting and evacuation of employees;
  • the allocation of personal protective equipment and work clothing and footwear to workers;
  • training of employees in the field of occupational health and safety.

Workers or their representatives may submit proposals to the employer to eliminate or reduce occupational hazards. They also have the right to demand that health and safety inspections be carried out and that legal measures be applied by inspectors of the National Labour Inspectorate.

It is the employer’s responsibility to provide adequate conditions for consultations and, in particular, to ensure that they take place during working hours. For the time not worked in connection with participation in the consultations, workers or their representatives shall retain the right to remuneration.

Workers or their representatives may not suffer any adverse consequences for themselves as a result of their consultancy activities; this also applies to employees or their representatives who are members of the OHS committee.
