What does the new statistical accident at work card look like?

The statistical accident at work card contains data on the employer, the victim, the accident at work, as well as its consequences, as well as the manner and deadlines for its preparation and transmission to the competent statistical office. From 1 January 2023, a new model will apply.

It is generally accepted that an accident at work is considered to be a sudden event caused by an external cause causing injury or death that occurred in connection with work:

  • during or in connection with the performance by the employee of the usual activities or orders of superiors;
  • during or in connection with the performance by the employee of activities for the employer, even without instructions;
  • while the employee is at the employer’s disposal on the way between the employer’s registered office and the place of performance of the obligation arising from the employment relationship.

A serious accident at work is an accident resulting in serious bodily injury, such as loss of vision, hearing, speech, reproductive capacity or other bodily injury or disorder of health, affecting basic functions of the body, as well as an incurable or life-threatening disease, permanent mental illness, total or partial inability to work in the profession or permanent, significant disfigurement or deformity of the body.

A collective accident at work is considered to be an accident involving at least two people as a result of the same event.

An accident at work is considered to be a fatal accident resulting in death within a period not exceeding 6 months from the date of the accident.

When a fatal, serious or collective accident occurs at work, the employer is obliged to immediately notify the competent district labor inspector and prosecutor.

In the event of an accident at work, the injured person or members of his or her family are entitled to m.in such benefits: one-off compensation – for the insured person who has suffered permanent or long-term damage to health, one-off compensation for family members of the deceased, sickness benefit, rehabilitation benefit, compensatory allowance, disability pension, training pension, survivor’s pension.

The employer has a duty to protect the life and health of employees in connection with their work. If an accident occurs, it is to ensure first aid to the injured persons and to determine the circumstances and causes of the accident. In addition, the employer is obliged to keep a register of accidents at work.

If an accident occurs at work, findings regarding the circumstances and causes of this accident are made in the post-accident report. This is a very important document, which can later be, for example, the basis for paying compensation to an employee.

The Regulation of the Minister of Family and Social Policy on the statistical accident card at work (No. in the list of legislative works of the Minister of Family and Social Policy – 72, hereinafter: the regulation), defines a new model of the card.

On the basis of an approved accident report or an accident at work card, a statistical accident at work card is drawn up. The statistical fiche shall be drawn up in accordance with the explanatory notes, classifications and code marks for the completion of that sheet, which are set out in the new Annex 2 to the Regulation.

The employer submits the completed statistical card within 14 working days from the date on which the post-accident report was approved or the accident report was drawn up. In turn, Part II, supplementary, of the statistical card is provided by the employer no later than 6 months from the date of approval of the post-accident report or from the date of drawing up the accident card.

The employer submits the card in electronic form to the reporting portal of the Central Statistical Office. An employer employing no more than 5 employees may submit the original of the statistical card drawn up in paper form to the Statistical Office in Gdańsk after sending a justified information about the choice of this form.

From 2023, the statistical accident card at work Z-KW will change, because it is necessary to adapt it to the Polish standards of the Central Statistical Office as well as European standards, i.e. the European Statistics on Accidents at Work (ESAW) issued on the basis of EU regulations. Poland provides data on accidents at work to ESAW. In turn, ESAW data is used by Eurostat (European Statistical Office).

The new template is to be easier to complete and to facilitate data processing at European level. In addition, according to the Ministry of Family and Social Policy: the expected effect of the regulation and the new charter will be to improve the level of occupational safety and health protection by obtaining more accurate data and a more accurate analysis of the circumstances and effects of accidents at work.

The statistical accident at work card contains, m.in, such data to be filled in:

  • number of employees in the local unit (without full-time conversion)
  • whether it was an accident at work or an accident treated on an equal footing with an accident at work
  • the town (municipality) in which the local unit is located
  • type of activity according to PKD and form of ownership
  • determination of gender, year of birth, nationality, employment status, occupation, length of service in the workplace (in years), hours worked from taking up work to the time of the accident
  • determination of the consequences of the accident, the type of injury and its location, the number of people injured
  • estimated material damage caused by the accident
  • place, date and time of the accident
  • activities performed by the victim at the time of the accident
  • the causes of the accident.
