What are the employer’s obligations to ensure adequate indoor health and safety?

The employer is obliged to organize the premises in such a way that they provide employees with safe and hygienic working conditions. This should be taken care of already at the construction stage and in the event of reconstruction, all necessary changes should be made resulting from current legal requirements and emerging new technical possibilities.

The employer is obliged to:

  • ensure that the construction or reconstruction of a work in which work premises are envisaged is carried out on the basis of projects taking into account health and safety requirements at work
  • ensure that the construction works in which the work premises are located are constructed and maintained in accordance with the requirements set out in the Construction Law and its implementing acts
  • provide work facilities appropriate to the type of work performed and the number of employees employed
  • maintain construction works, work premises and associated land and equipment in a condition ensuring safe and hygienic working conditions
  • ensure that the owner or manager inspects the work.

Inspections of the work are carried out:

  • periodically, at least once a year – check the technical condition:
    • elements of the building, structures and installations exposed to harmful atmospheric influences and destructive effects of factors occurring during the use of the facility
    • installations and equipment for environmental protection
    • gas installations and chimney ducts (smoke, flue gas and ventilation)
  • periodically, at least once every 5 years – they consist in checking the technical condition and suitability for use of the building object, the aesthetics of the building object and its surroundings, examination of electrical and lightning protection installations regarding the efficiency of connections, accessories, protection and protection measures against shocks, resistance to insulation of wires and grounding of installations and apparatus.

Inspections are carried out by people with building licenses of the appropriate specialty.
