Is the manager obliged to check the employee’s wearing of corrective glasses during work?

The task of the persons managing the employees is to ensure the implementation of the recommendations of the doctor providing health care for employees. If the person using the screen monitor obtains a ruling on the absence of contraindications to work, and the content of the judgment will result in a recommendation to work in eyeglasses correcting vision, then it will be necessary to provide such glasses by the employer.

Regulations in the field of technical occupational safety distinguish a special category of people – which are people managing employees. The unique role of persons managing employees is manifested in the fact that the regulations regulate the scope of duties of such persons. It is included in Article 212 of the Labour Code. The scope of duties of the persons in charge includes, in particular: quote: „ensure the implementation of the recommendations of the doctor providing health care for employees”.

On the other hand, performing work in front of a screen monitor is associated not only with loads on the musculoskeletal system of the organ of vision. This means that as part of preventive medical examinations, as part of which the condition of the organ of vision is controlled, some employees receive a recommendation to work in glasses that correct vision.

The employer is obliged to provide employees with eyeglasses correcting vision, in accordance with the doctor’s recommendation, if the results of ophthalmological examinations carried out as part of preventive health care show the need for their use when working with a screen monitor.

In the scope of the role of the person managing employees mentioned at the beginning, an important question arises for the practice, what is the scope of supervision over the implementation of the doctor’s recommendation to work in eyeglasses correcting vision? Should the person in charge only ensure that the employee directly reporting to him has vision-correcting glasses provided by the employer? Or maybe the obligation to ensure the implementation of the recommendations of the doctor providing health care for employees should be understood more broadly, as ongoing supervision over the actual use of glasses at work?

The provision on the obligation to ensure the implementation of the recommendations of the doctor providing health care for employees may suggest that the implementation of the recommendation (including its monitoring by the person in charge) ends with the provision of glasses by the employer, i.e. their financing. Such an understanding of the provision in practice could exempt the person managing employees from ongoing supervision in the use of corrective glasses. To sum up, it can be assumed that the concept of ensuring the implementation of the recommendations of the doctor providing health care for employees, in the case of eyeglasses correcting vision, includes both the obligation to supervise the employer’s activities in the field of providing glasses and their delivery to the employee, as well as supervision over employees in the field of current use of corrective glasses.
