Is it obliged to wear a mask in the workplace?

The obligation to cover the mouth and nose with clothing or parts thereof, masks, helmets or protective helmets applies to public places, including workplaces (in accordance with the provisions of the Regulation on the establishment of certain restrictions, orders and prohibitions in connection with the occurrence of an epidemic).

Currently, the obligation to cover the mouth and nose is only carried out by means of a mask (Section 25(1) of the Regulation: „Until 28 March 2021, it is ordered to cover, by means of a mask, mouth and nose: 2) in public places, including: (c) in workplaces, if there are more than 1 person in the room, unless the employer decides otherwise …’)

The legislature therefore made the implementation of that obligation subject to the employer’s decision. The establishment of a regulation different from that of a provision should include the employer in an internal document and inform employees of that regulation in the manner adopted in the workplace.

Please note that if you do not have to cover your mouth and nose in public places, the requirement to maintain a distance between workplaces of at least 1.5 m or to provide personal protective equipment related to the fight against the epidemic remains valid if it is impossible to maintain this distance. It should be borne in mind that products intended to cover the mouth and nose must not be regarded as the same as personal protective equipment with which the employer is obliged to equip workers if the nature of the undertaking’s activities does not allow the intervals between the workplaces of not less than 1,5 metres to be 7.5 metres.

The absolute obligation to cover the mouth and nose applies to persons performing direct service to interested parties or customers during its performance in certain public buildings. These persons should be further protected against possible sars-cov-2 virus emissions, e.g. by the use of a physical partition separating them from the customer, by maintaining an increased distance (min. 1,5 m) of the interested party from the service station or otherwise depending on the nature of the work (activities performed) and the results of the risk analysis carried out.

According to the current regulations, the discovery of the mouth and nose is possible in the case of eating meals or drinks in workplaces (under the Regulation on the establishment of certain restrictions, orders and prohibitions in connection with the occurrence of an epidemic).
